Thank you for choosing to use FlexPark. These Terms & Conditions regulate your access to and use of the FlexPark mobile application and website (“FlexPark”, “we”, “us”, “our”).
FlexPark is operated by Noctocode d.o.o., headquartered at Oražnova ulica 1, 1000 Ljubljana, Slovenia.
PLEASE READ THESE TERMS CAREFULLY BEFORE USING OR ACCESSING THE SERVICE OR THE WEBSITE.
By using or accessing FlexPark, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.
If you are using the Service on behalf of an organization, you confirm that you have the authority to bind that organization to these Terms. In this case, “You” and “Your” will refer to that organization.
If you do not agree to these Terms, please do not use the Service or the Website.
By accepting these Terms, you warrant that you are at least eighteen (18) years old and legally capable of entering into binding contracts. If you are accepting these Terms on behalf of an organization, you represent and warrant that you are properly authorized to do so.
1. These Terms & Conditions (“T&Cs”) define the conditions for the provision of services by the Operator via the FlexPark Application to the Customer.
2. In these T&Cs, the following definitions apply:
2.1. Operator – Noctocode d.o.o., with headquarters at Oražnova ulica 1, 1000 Ljubljana, Slovenia, acting as the service provider of the FlexPark Application.
2.2. Customer – a business entity (a natural person acting for their enterprise, a legal person, or an organizational unit without legal personality, granted legal capacity by law) that registers a Customer Account and uses the Application through designated Users.
2.3. User – a natural person authorized by the Customer to use the Application under the Customer Account, by creating and activating a User Account.
2.4. Application (FlexPark) – mobile applications available on Google Play and Apple App Store under the name FlexPark enabling the management and reservation of office parking spaces.
2.5. Parking Space – a parking spot managed by the Customer and allocated for booking and shared use by Users through the Application.
2.6. Website – the public website at https://flexpark.org, where the Operator provides information about Subscription Plans, pricing, and terms of service.
2.7. Customer Account Administrator – a natural person authorized to administer the Customer Account on behalf of the Customer (with the necessary legal authority or representation rights), who manages account settings, invites Users, and selects Subscription Plans.
2.8. Login – a unique email address used as the User’s identifier in the Application.
2.9. Password – a confidential string of characters created by the User, required to log into the Application.
2.10. Customer Account – a set of settings and data associated with the Customer in the Application, linked to the selected Subscription Plan.
2.11. User Account – a set of settings in the Application assigned to a User, protected by Login and Password, linked to the Customer Account.
2.12. Price List – the Operator’s offer describing available Subscription Plans and associated fees, published on the Website.
2.13. Subscription Plan – a package of services and features provided by the Operator during a Subscription Period, as selected by the Customer.
2.14. Subscription Period – the duration (monthly or yearly) of the Customer Account’s validity and access to the Application, as determined by the chosen Subscription Plan.
2.15. Subscription Fee – the fee payable by the Customer for maintaining a Customer Account and accessing the Application, as specified in the chosen Subscription Plan.
2.16. Trial – a free test period of the Application (30 days) from the date of registering the Customer Account, unless otherwise agreed with the Operator.
2.17. Services (Service) – provision of the FlexPark Application in a SaaS model, enabling Customers and Users to manage parking reservations, subject to these T&Cs.
2.18. Customer Support – the Operator’s support channel available via email at support@flexpark.org, typically during regular working hours (CET), excluding weekends and public holidays.
2.19. Agreement – the agreement for the provision of electronic services, concluded between the Operator and the Customer upon acceptance of these T&Cs, covering the use of the Application under the chosen Subscription Plan.
2.20. T&Cs – this document, together with Subscription Plan details, forming the contractual terms between the Operator and the Customer.
Because the Service and the Website will continue to evolve as we add new features and improvements, we may modify, suspend, or terminate the Service or the Website at any time. We may also remove or adjust any content or data from the Service or the Website at our discretion.
The processing of personal data provided through the Service and the Website is described in detail in our Privacy Policy, which forms an integral part of these Terms.
FlexPark provides a mobile application designed for organizations and individuals who need a simple tool for managing office parking spaces. The Service is available exclusively through the FlexPark mobile applications (iOS and Android).
FlexPark offers a 30-day free trial to new Customers. When the trial ends, the subscription will automatically convert into the plan selected at registration, unless the User cancels before the trial expires (see Section: Payments & Pricing – Free Trial).
In cases of a clear violation of these Terms, misuse of the Service, or use beyond the agreed scope, FlexPark reserves the right to restrict or delete a User Account or Customer Account.

As a User, you always have access to your personal data in order to view or update information such as your password or vehicle details.
FlexPark will not access or modify any data or content unless it is necessary to:
FlexPark will not disclose any User data or content except as described in the Privacy Policy and in these Terms.
FlexPark complies with the General Data Protection Regulation (GDPR) and applicable data protection laws.
The relationship between Users and FlexPark (Noctocode d.o.o.) shall be governed by the laws of Slovenia, excluding any provisions allowing for a referral to other legal systems.
A FlexPark User Account (henceforth referred to as “Account”) may be created by the User through the registration process in the FlexPark mobile application.
Access to the Account is provided on the basis of:
To create an Administrator Account, a User must complete the registration process in the FlexPark mobile application and select “Create Organization” during setup. The User will then be guided through an onboarding process to configure the parking lot.
An Administrator role can also be assigned to an existing Parking User by contacting our support team at support@flexpark.org.
Administrators have the right to manage the parking lot they are assigned to, including the ability to:
A Parking User can start using the FlexPark app after receiving an invitation email from an Administrator of a specific parking lot. The email contains a “Join Organization” link, which guides the User to download the mobile application and complete the registration process.

Users may cancel their FlexPark Account at any time and for any reason directly within the mobile application by using the account deletion option in the settings.
Once cancelled, we may permanently delete your Account and all associated data, in accordance with our Privacy Policy and data retention rules.
Free Trial
New Customers may use FlexPark free of charge for a 30-day trial period.
When the trial ends, the subscription will automatically convert into the plan selected at registration. Unless the User cancels the subscription before the trial expires, subscription fees will be charged based on the chosen plan.
Premium Subscription
FlexPark subscriptions are offered as in-app purchases through Google Play (Android) and Apple App Store (iOS).
If your company requires an invoice with VAT, please contact us directly at support@flexpark.org. In such cases, we will prepare a tailored subscription plan, set up your organization’s account, and issue invoices accordingly.
If you wish to dispute a charge, you must contact Google Play, the Apple App Store, or FlexPark (for invoiced plans), depending on the payment channel used.
Subscription Plans
FlexPark currently offers multiple subscription tiers based primarily on the number of reservations included per month:

All Subscription Plans include core features and access to customer support.
Term & Renewal
Premium subscriptions run for an open-ended term and renew automatically each billing cycle (monthly or yearly, depending on the plan) until cancelled.
How to Cancel
Either party may terminate the subscription at any time without giving a reason, subject to the rules above.
Access After Cancellation
After cancellation, you will retain access to the Service until the end of the period already paid for. After that date, access to the Account will be disabled.
Data After Cancellation
Following the end of your paid period, your Account may be permanently deleted, including data associated with it, in line with our Privacy Policy and data-retention rules. Deleted data cannot be restored.
Complaints
Complaints or notices regarding billing, access, or Service issues can be submitted to support@flexpark.org. We review and respond within 5 business days.
All amounts paid for FlexPark subscriptions are non-refundable.
FlexPark reserves the right to change subscription prices in the future. If prices change, we will provide notice at least 30 days in advance, either through the mobile application, the Website, or by email.
If you continue to use FlexPark after the new pricing takes effect, this will be considered your agreement to pay the updated subscription fees.
For subscriptions purchased through Google Play or the Apple App Store, refund requests must follow the respective store’s refund policies.
FlexPark, operated by Noctocode d.o.o., reserves all proprietary rights, including but not limited to patents, trademarks, service marks, and copyrights related to the Service and the Website.
As a User, you agree to respect FlexPark’s intellectual property rights. You may only use our brand assets with our prior written consent.
We may review content entered into FlexPark only when necessary to:

2. In matters not regulated by these T&Cs and/or a separate written agreement between the Operator and the Customer, the provisions of Slovenian civil law and other applicable legislation shall apply.
